Terms of Service

Effective July 11, 2026

These Terms of Service (“Terms”) govern your access to and use of the AIPhonez website, platform, and services (the “Service”), operated by BizFlow AI Solutions LLC(“Company,” “we,” “us”). By creating an account, building an agent, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

AIPhonez lets you build, test, and deploy AI-powered phone agents for your business. You can build and test an agent for free (free test calling is limited — currently 5 total minutes of in-browser test calls per account). Putting an agent live on a real phone number requires activation and a payment method on file. Live usage is billed at the published per-minute rate (currently $0.75 per minute of live talk time), invoiced automatically every 14 days or when unbilled usage reaches $50, whichever comes first. Rates and limits may change with notice on this page or in your dashboard.

2. Your Agents Are Your Sole Responsibility

You are solely responsible for the agents you build, configure, and deploy, and for all use, behavior, and output of those agents. BizFlow AI Solutions LLC provides the tools only, and is not responsible or liable for any results, outcomes, losses, damages, or issues arising from your agents or your use of the Service. This includes, without limitation: what your agent says to callers; appointments it books or fails to book; calls it answers, misses, drops, or transfers; information it provides or omits; text messages and notifications sent on your behalf; and any business, legal, or financial consequence of any of the above.

You are responsible for ensuring your agent and your use of the Service comply with all laws that apply to you and your business, including without limitation:

  • telephone-communication laws and regulations (including the TCPA and state telemarketing rules);
  • call-recording consent laws — calls handled through the Service may be recorded and transcribed, and some states require the consent of all parties; obtaining any required consent from your callers is your responsibility;
  • industry-specific rules that apply to your business (for example, do not use the Service to collect or handle protected health information unless you have confirmed with us in writing that your configuration supports it);
  • consumer-protection and advertising laws governing any claims your agent makes.

3. AI Disclaimer

The Service uses artificial intelligence. AI output can be inaccurate, incomplete, or unexpected. You must review and test your agent before and after putting it live, and you accept that the Company does not guarantee the accuracy, appropriateness, or completeness of anything an agent says. The Service is not suitable for emergency use — agents cannot place or handle 911 or other emergency calls.

4. Acceptable Use

You agree not to use the Service to:

  • break the law, or configure an agent that does;
  • place or facilitate robocalls, spam, or unsolicited outbound campaigns in violation of applicable law;
  • impersonate another person or organization, or misrepresent who the agent represents;
  • harass, defraud, or harm any person;
  • probe, disrupt, or abuse the platform, other customers’ data, or our rate limits.

We may suspend or terminate accounts that violate these Terms, with or without notice.

5. Billing & Payment

  • Activation requires a payment method saved with our payment processor (Stripe). We do not store your card details.
  • Usage is metered per minute of live talk time and charged automatically to your saved payment method every 14 days or at $50 of unbilled usage, whichever comes first.
  • Free in-browser test calls are not billed.
  • If a charge fails and remains unpaid, we may suspend service and release your phone number after reasonable notice.
  • You are responsible for any applicable taxes.

6. Phone Numbers

Phone numbers are provisioned through third-party telephony providers. Numbers on an account that is cancelled or materially past due may be released. If you need to port a number in or out, contact support.

7. Your Content & Data

You retain ownership of the content you provide (your website content, prompts, business information) and your call data. You grant us the license needed to operate the Service — for example, to read your website to build your agent, and to process call recordings and transcripts so we can deliver summaries and features to you. Our handling of personal data is described in the Privacy Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY AGENT WILL PERFORM TO ANY PARTICULAR STANDARD.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZFLOW AI SOLUTIONS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, OR LOST DATA, ARISING FROM OR RELATED TO THE SERVICE OR YOUR AGENTS — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You will defend, indemnify, and hold harmless BizFlow AI Solutions LLC and its members, officers, and agents from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from your agents, your content, your use of the Service, or your violation of these Terms or applicable law.

11. Termination

You may cancel at any time from your dashboard or by contacting support; unbilled usage will be charged at cancellation. We may suspend or terminate the Service for breach of these Terms, non-payment, or risk to the platform or other customers.

12. Changes

We may update these Terms from time to time. The effective date above reflects the latest version, and continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue for any dispute lies in the state or federal courts located in Texas.
